§ 1 Scope

These Terms govern the use of Wishpicker (https://wishpicker.app), a free web application for creating and sharing wishlists, operated by PWilli IT & Bild.

§ 2 Description of the Service

Wishpicker enables registered users (list creators) to build collaborative wishlists, add products from various online shops, and send individualised participant links to family and friends. Invited participants can reserve wishes without an account. The service is free. No registration is required; the list creator authenticates via an admin link delivered by email.

§ 3 User Obligations

Users agree not to use Wishpicker for unlawful purposes, not to upload illegal or rights-infringing content, and in particular not to create wishlists for collecting personal data of third parties without their consent.

§ 4 Availability

Wishpicker is operated with due care, but no specific availability is guaranteed. Maintenance work, technical issues, or outages at the cloud providers we use (Cloudflare) may cause temporary restrictions.

§ 5 Limitation of Liability

Wishpicker assumes no liability for the content or availability of linked external online shops. Product information automatically retrieved from external shops may be incorrect, outdated, or incomplete. No warranty is given for the timeliness, completeness, or availability of the displayed products or prices. Contracts between participants and external online shops are concluded exclusively between those parties.

§ 6 Participation in the Amazon Associates Programme

Wishpicker is a participant in the Amazon Associates Programme (Amazon EU S.à r.l.), an affiliate advertising programme designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.de. When you reach Amazon.de via a product link posted on Wishpicker and make a qualifying purchase there, Wishpicker receives a commission from the seller. This does not result in any additional cost to you as the buyer. Affiliate links on Wishpicker carry the tracking parameter tag= ; this is the only technical mechanism used to attribute the commission. The sale transaction is concluded exclusively between you and Amazon; Wishpicker is not a contractual party and assumes no liability whatsoever for the order processing.

§ 7 Data Protection

The separate provisions of the Privacy Policy apply.

§ 8 Changes to these Terms

These Terms may be updated when the service changes substantially or due to legal requirements. Substantial changes will be announced on the home page; otherwise the version published on this page at the relevant time applies.

§ 9 Final Provisions

Swiss law applies, with the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
